In our previous blog post about the Common Mistakes Made in Personal Injury Claims, we discussed how not hiring a personal injury lawyer and not seeking medical attention right away after an injury can be major mistakes made after a personal injury. However, these are just two of several mistakes that can be made by injured parties after a personal injury has occurred. Additional errors that can cause injured parties and their families to lose out on potential compensation form a personal injury include:
● Not following through with treatment advice: Not only is it important to get medical treatment and advice after an accident, but it is also important to follow through with it. Failure to follow through with medical advice and treatment can give defendants in a personal injury lawsuit leeway to argue your injuries were not that serious or your own behavior exacerbated your injuries. Both arguments can have major impacts on a settlement or if the case goes to court.
● Not getting witness contact information: As mentioned in previous blogs, witnesses can be extremely helpful in personal injury cases. However, if you fail to get their information at the time of the accident it may be impossible to track down witnesses if your personal injury case goes to court. In addition, if a personal injury defendant knows there is strong evidence against them, including a witness’s testimony, they may be more willing to settle the case out of court.
These are just two of the many common mistakes claimants can make when filing a personal injury claim. If you or a loved one has been injured call Greenberg Law P.C. Our team of lawyers will discuss your case with you and can advise you on your best course of action.
